About Copyright

Railroadheritage.org is produced and managed by the Center for Railroad Photography & Art, Inc. (the "Center"). The Center protects and promotes individual artists and their work. Part of this mission includes exercising due diligence in observing copyright laws while also promoting access to view individual and institutional collections.

We are proud to be able to feature selections from our collaborators. The design of the portal, its search-utility, and dynamic link-ups are intended to showcase both the owners and the work itself. Attribution is a high priority for this program.

In this spirit, if there are concerns about a particular image's inclusion and/or attribution, we encourage you to contact us directly at info@railphoto-art.org. In our experience, discrepancies are very easily resolved; the Center is committed to actions that preserve relationships in our community and protect artists and their work.

In formal terms, the Center in this program is an online service provider; the digital images and all related copyright rights remain property of their creator or owner. The Center has registered a designated agent with the U.S. Copyright Office, and has adopted and posted a Digital Millennium Copyright Act (DMCA) policy. The DMCA policy provides further information about the Center's role as a provider and sets out formal procedures you must follow if feel that material available on a Center website infringes any of your exclusive rights under US copyright law. The Center relies upon its collaborators to guarantee that all images they select for inclusion in the portal are properly cleared for copyright purposes. The Center requires all content providers, whether collecting institutions, private collectors, or artists themselves, to affirm that they have the right to publicly display the images they choose to include. The Center cannot guarantee the accuracy of such content provider statements, however, and does not independently investigate the copyright status of images posted on the portal.

If you are a copyright owner, we rely on you to advise us of any copyright concerns by following the procedures set forth in our DMCA policy.

If you are a user of the portal, and you wish to do anything other than simply view the displayed images, you must seek permission from the copyright owner of the image(s) in question.

We don't assume any liability and we aren't making any warranties. That sounds simple enough, but to make it legal, we have to say it this way, in prominent lettering: RAILROADHERITAGE.ORG (THE "SITE") IS PROVIDED "AS IS." THE CENTER EXPRESSLY DISCLAIMS ALL WARRANTIES EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, ACCURACY, INTEGRATION, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE SITE OR ANY PARTICULAR APPLICATION OR USE OF THE SITE.

IN NO EVENT SHALL THE CENTER BE LIABLE FOR ANY LOSS OF PROFIT OR ANY OTHER COMMERCIAL DAMAGE, INCLUDING BUT NOT LIMITED TO SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES UNDER ANY CAUSE OF ACTION ARISING OUT OF OR RELATING TO THE SITE.


The portal, at this time, offers low resolution digital images for viewing only. The content on the portal is intended to provide material for scholars, artists, and enthusiasts alike to be able to view image collections that are contextualized and referenced. For any other use of the images, you must request an appropriate license from the copyright owner.

For your convenience, the portal provides specific links for direct contact to the image contributors. Please understand: the contributor may not be the copyright owner. But the contributor certainly is a good place to start, should you need to locate the copyright owner. For additional copyright research you may wish to consult the US Copyright Office website { http://www.copyright.gov }

Railroadheritage.org embraces technology to serve as an instance of educational outreach and access—we approach this mission with good faith that our collaborators share our intent, and will commit to friendly measures to resolve any problems. The future of this endeavor will require ongoing collaboration and goodwill amongst our users, the content providers and the Center.
